Contract specifications
6. Description of the contract: The object of this work contract concerns the remediation of the Beshtau and Byk uranium mines, the decommissioning of the GMZ works and the upgrading of the GMZ tailings ponds in the region of Lermontov, Russian Federation. The contractor will develop the remediation design for the 4 sites and execute the remediation of 2 of the sites. 7. Number and titles of lots: 1 lot.
Terms of participation
8. Eligibility and rules of origin: Participation is open to all legal persons participating either individually or in a grouping (consortium) of tenderers which are established in a Member State of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the programme under which the contract is financed (see also heading 22 below) as follows: Armenia, Azerbaijan, Belarus, Croatia, FYROM, Georgia, Iceland, Kazakhstan, Kyrgyzstan, Liechtenstein, Moldova, Mongolia, Norway, Russian Federation, Tajikistan, Turkey, Turkmenistan, Ukraine and Uzbekistan. All works, supplies and services under this contract must originate in 1 or more of these countries. Participation is also open to international organisations. The participation of natural persons is directly governed by the specific instruments applicable to the programme under which the contract is financed. 9. Candidature: All eligible natural and legal persons (as per item 8 above) or groupings of such persons (consortia) may apply. A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (i.e., the leader and all other members) are jointly and severally liable to the contracting authority. The participation of an ineligible natural or legal person (as per item 8) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded. 10. Number of applications: No more than 1 application can be submitted by a natural or legal person whatever the form of participation (as an individual legal entity or as leader or member of a consortium submitting an application). In the event that a natural or legal person submits more than 1 application, all applications in which that person has participated will be excluded. 11. Shortlist alliances prohibited: Any tenders received from tenderers comprising firms other than those mentioned in the shortlisted application forms will be excluded from this restricted tender procedure. Shortlisted candidates may not form alliances or subcontract to each other for the contract in question. 12. Grounds for exclusion: As part of the application form, candidates must submit a signed declaration, included in the standard application form, to the effect that they are not in any of the exclusion situations listed in Section 2.3.3 of the 'Practical Guide to contract procedures for EC external actions'. 13. Subcontracting: Subcontracting will be allowed and the maximum percentage of the contract value which may be subcontracted is 30 % of the total contract value.
Provisional timetable
14. Provisional date of invitation to tender: October 2008. 15. Provisional commencement date of the contract: March 2009. 16. Initial period of execution and possible extension of the contract: 60 months.
Selection and award criteria
17. Selection criteria: The following selection criteria will be applied to candidates. In the case of applications submitted by a consortium, these selection criteria will be applied to the consortium as a whole: 1) Economic and financial capacity of candidate (based on item 3 of the shortlist application dossier), minimum requirements: (a) the average of the annual value of construction work over the last 3 accounting years (i.e. 2005, 2006 and 2007) of the candidate must exceed EUR 50 000 000. 2) Professional capacity of candidate (based on items 4 and 5 of the shortlist application dossier), minimum requirements: (a) the average over the last 3 years of permanent staff working in fields related to this contract is at least 50 permanent staff. 3) Technical capacity of candidate (based on items 5 and 6 of the shortlist application dossier): (a) The candidate must have successfully participated in at least 3 similar projects on remediation and decommissioning. For each of the 3 selected projects he must have implemented at least 30 % of the project budget. The total contract value of each of the 3 selected projects shall be at least EUR 3 000 000. Projects presented for this criterion must either have ended after 1.1.2004 or must still be ongoing; (b) the candidate has successfully participated in at least 1 similar project on remediation and decommissioning in the countries covered by the financing instrument. Projects presented for this criterion must either have ended after 1.1.2004 or must still be ongoing; (c) quality assurance system: the candidate must be ISO 9001 certified or equivalent. An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has with them. It must in that case prove to the contracting authority that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Such entities must respect the same rules of eligibility and notably that of nationality, as the economic operator. 18. Award criteria: Price.
Shortlist application
19. Deadline for submission of shortlist application dossier: 28.8.2008 (16:00). Any application received after this deadline will not be considered. 20. Application format and details to be provided:
Applications must be submitted using the shortlist application dossier, whose format and instructions must be strictly observed. An electronic copy may be requested by email to EuropeAid-ENPI-EAST-TENDERS@ec.europa.eu mentioning the contract title and the publication reference. Any additional documentation (brochure, letter, etc.) sent with an application will not be taken into consideration. 21. How applications may be submitted: The shortlist application dossier must be submitted in English exclusively to the contracting authority: — either by recorded delivery (official postal service) to:
European Commission, EuropeAid Co-operation Office, J-54 2/221, Avenue du Bourget 1, B-1049 Bruxelles/Brussel, — or hand-delivered (including courier services) directly to the contracting authority in return for a signed and dated receipt to: European Commission, EuropeAid Co-operation Office, J-54 2/221, Avenue du Bourget 1, B-1140 Bruxelles/Brussel. The contract title and the publication reference (see item 1 above) must be clearly marked on the envelope containing the application and must always be mentioned in all subsequent correspondence with the contracting authority. Applications submitted by any other means will not be considered. 22. Alteration or withdrawal of applications: Candidates may alter or withdraw their applications by written notification prior to the deadline for submission of tenders. No application may be altered after this deadline. Any such notification of alteration or withdrawal shall be prepared and submitted in accordance with clause 21. The outer envelope (and the relevant inner envelope) must be marked 'Alteration' or 'Withdrawal' as appropriate. 23. Operational language: All written communications for this tender procedure and contract must be in English. 24. Date of publication of contract forecast: 31.5.2008. 25. Legal basis: Council Regulation (EC, Euratom) No 99/2000 of 29.12.1999 concerning the provision of assistance to the partner States in eastern Europe and central Asia, as amended by Council Regulation (EC) No 2112/2005 of 21.11.2005 on access to Community external assistance.
