Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
a) All eligible natural and legal persons or consortia of such persons may apply (‘joint tender’). Each legal entity will be required to sign the contract in the case of award, and shall assume joint and several liability towards the contracting authority for the fulfilment of the terms and conditions of the contract.
b) Any change in the composition of the consortium during the procurement procedure may lead to the rejection of the corresponding tender. Any change in the composition of the consortium after the signature of the contract may lead to the termination of the contract.
c) The consortium shall nominate 1 legal entity (‘the leader’) who will have full authority to bind the consortium and each of its members, and will be responsible for the administrative management of the contract (invoicing, receiving payments, etc.) on behalf of all other entities.
d) Subcontracting is allowed but the contractor shall retain full liability towards the contracting authority for implementation of the contract. Any change in subcontracting during the procurement procedure may lead to the rejection of the corresponding tender. Any change in subcontracting after the signature of the contract may lead to the termination of the contract.
e) An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has with them.
It must in that case prove to the contracting authority that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal.
f) Consortia must provide the documents and information required in point III.2.1 for each individual member thereof and for subcontractors.
In the case of a joint offer by a consortium, the criteria in points III.2.2 and III.2.3 apply to the consortium as a whole.
g) The participation of an ineligible natural or legal person will result in the automatic exclusion of that person. In particular, if the ineligible person in the sense of the conditions set out in point III.2.1 belongs to a grouping, the whole grouping will be excluded if it doesn't fulfil all selection criteria without the excluded member.

Information and formalities necessary for evaluating if the requirements are met: Tenderers will not be eligible to take part in this contract award procedure if they are in any of the exclusion situations listed in Articles 106 and 107 of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25.10.2012 (OJ L 298, 26.10.2012). According to this provision, tenderers are required to submit a declaration on their honour. The template is available at the link provided in Section VI.3(b).
Should a contract be awarded, the contractor will need to provide the supporting documents required in Article 143(3) of Commission Delegated Regulation (EU) No 1268/2012.
In the case of consortia, they must provide the documents and information required in this paragraph for each individual member thereof and for subcontractors.

a) With reference to Section IV.3.4, ‘Time limit for receipt of tenders or requests to participate’, requests to participate must be sent in duplicate not later than 26.11.2015 (postal service date) or delivered by hand not later than 26.11.2015 (16:00) at the address mentioned in Section I.1. In the case of hand delivery, a receipt must be obtained as proof of submission, signed and dated by the Commission's Central Mail Department.
