Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
Economic operators may submit a tender either individually or as part of a grouping (with or without a legal personality). Subcontracting is permitted in all cases.
The tenderer must clearly state the role of each economic operator (an individual tenderer, a grouping member or a subcontractor). This also applies to those entities forming part of an economic grouping.
All grouping members shall be jointly and severally liable vis-à-vis the contracting authority for contract performance and, if awarded the contract, will be required to sign it. The grouping must therefore submit a declaration stating the leader who will have full authority to represent the grouping and each of its members during contract performance. He shall be responsible for contract administration (invoicing, receiving payments, etc.) on behalf of all members.
Subcontracting is when the contractor enters into legally binding commitments with other entities that will perform parts of the contract in his name. The contractor retains full responsibility vis-à-vis the contracting authority for contract performance. The tenderer must state the proportion of the contract he intends to subcontract and specify all subcontractors:
— whose capacities they may rely on in order to meet the minimum requirements in points III.2.2 and III.2.3 of this contract notice,
— who carry out a proportion of the contract that is more than 10 %,
— if the total subcontracted amount is more than 10 % of the contract.
Furthermore, the tender must include a letter of intent from each subcontractor, in which the latter affirms his unequivocal willingness to cooperate with the tenderer. During contract performance, the replacement of subcontractors shall be subject to the contracting authority's prior written approval.
An economic operator or a grouping may also rely on the capacities of other entities in order to meet the conditions for participation stated in points III.2.2 and III.2.3 of this contract notice, regardless of the legal nature of the links it has with them. In such an event, he must provide the contracting authority with proof that he will have the resources needed to perform the contract by, for example, producing a written commitment by said entities to make such resources available. If the tenderer relies on the capacities of a third party that is a legal entity other than the tenderer or the grouping, this shall be considered as subcontracting under the procedure despite the fact that said party forms part of a joint economic grouping. Should the third party represent more than 70 % of the minimum economic and financial capacity requirements listed in point III.2.2 of this contract notice, the contracting authority will ask the party to sign the contract, thereby becoming jointly and severally liable for its performance.
The role and duties of all grouping members or listed subcontractors must be clearly stated in the tender. The covering letter must state the name of the tenderer (including all partners in the case of a grouping) and subcontractors, including third parties whose capacities the tenderer may rely on, as well the name of the contact person for this procedure. For groupings, the covering letter must be signed by each member, or by the member appointed as the leader for the tender and management of the contract.
The tenderer (all members in the case of a grouping) must also submit a legible copy of the nomination of those persons authorised to represent him at administrative level and during legal proceedings, or a copy of the publication of said nomination, if applicable legislation in the country where he is established so requires.

Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: 1. to be eligible to take part in this contract award procedure, the tenderer must not be in any of the exclusion situations listed in Articles 106 and 107 of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25.10.2012 on the financial rules applicable to the general budget of the Union and repealing Council Regulation (EC, Euratom) No 1605/2002 (OJ L 298 of 26.10.2012).
To ensure application of the aforementioned standards, the tenderer must submit a declaration on honour proving that he is not in any of the situations listed in Articles 106 and 107 of the Financial Regulation (available on the tender website, see point I.1 of this notice). At the end of the procedure, the successful tenderer will need to produce the supporting documents required in Article 143(3) of Commission Delegated Regulation (EU) No 1268/2012 of 29.10.2012 on the rules of application of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council on the financial rules applicable to the general budget of the Union (OJ L 362 of 31.12.2012).
2. The tenderer must submit the original or true copy of certification by the Chamber of Commerce to the effect that he has performed an activity related to that required under this invitation to tender for at least 3 years; self-certification is not accepted.

Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: (a) at least 1 bank reference confirming the tenderer's sound financial situation,
(b) statement as to the company's annual turnover for services under this contract, realised in the past 3 financial years for which accounts have been closed.
Minimum level(s) of standards possibly required: with regard to point (b), to be eligible, companies must submit a declaration for a sum of at least 200 000 EUR/year for lot 1 and 100 000 EUR/year for lot 2.
