Total quantity or scope:
The Framework Service Contracts are intended to be signed for an initial period of 1 year and can be renewed up to 3 times under the same conditions for a total maximum duration of 4 years. The maximum Contract value for the total duration of 4 years shall not exceed 200 000 EUR (excluding VAT) without this amount being binding to Fusion for Energy. It includes all expenses under the Contract including reimbursement of travel and subsistence expenses and the costs of the Mediation Venue. The volume of the services will depend on the number of disputes arising from Fusion for Energy's operational contracts; Fusion for Energy does not commit to exact volume to be requested.

III.2.1)
Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Tenderers shall provide a declaration on their honour, duly signed and dated, stating that they are not in any of the exclusion situations listed in the Tender Specifications, failing which they shall be excluded from participation. Please also consult the integral text of the declaration on honour annexed to the Tender Specifications. The tenderer to whom the contract is awarded shall be requested to provide, within a time limit defined by Fusion for Energy and preceding the signature of the contract, the documentary evidence stipulated in the Tender Specifications confirming the declaration on honour.
Tenderers (including all consortium members and any proposed subcontractors) are asked to prove that they are authorised to perform the Contract under the national law as evidenced by enrolment (declaration or certificates) in the professional or commercial/trade register imposed by the country in which the tenderer is established, or a sworn declaration or certificate, membership of a specific organisation, express authorisation or entry in the VAT register, specifically for practising activities relevant to the scope of this tender. Information and formalities necessary for evaluating if the requirements are met: Criteria: Annual turnover per year for the previous 3 financial years.
Evidence: 1 of the following:
— Annual accounts, balance sheets or extracts (where publication of the balance sheet is required under company law in the country of establishment) for the previous 3 financial years;
— Statement of the tenderer's overall turnover for the previous 3 financial years.

Information and formalities necessary for evaluating if the requirements are met:
a) Criteria: Continuity of the services in the market.
Evidence: Declaration of authorised representative or certificates proving the enrolment in the professional or commercial/trade register imposed by the country in which the tenderer is established, as indicated in Section 5.5.1 of the Tender Specifications.
b) Criteria: Experience in important international commercial disputes settled in the last 3 years.
Evidence: A list of at least 5 relevant international commercial disputes settled in the last 3 years, indicating:
— Dates,
— Parties to the dispute (Parties' names may be omitted, if confidential),
— Whether the parties were public or private sector entities,
— Value of the claim,
— A short summary,
— Aspects of the case relevant for the Fusion for Energy situation (international dispute, involvement of pubic body).
The list may not be longer than 2 pages.
c) Criteria: A pool of suitable mediators.
Evidence: A list of at least 10 mediators and their CV's. In order to substantiate compliance with the requirements, for each CV submitted a summary table should be attached to it using the format in Annex VI. The summary table shall, in an unambiguous manner, indicate what data/details from a submitted CV are being used to address/demonstrate compliance with the skills required.
d) Criteria: Mediation rules of procedure and template of Mediation Agreement.
Evidence: Copy of the Mediation rules of procedure and template of Mediation Agreement.
e) Criteria: Facilities and support tools and services of tenderer's premises as a Mediation Venue.
Evidence: Declaration by authorized representative.
f) Criteria: Guarantees of independence, neutrality and objectiveness.

Minimum level(s) of standards possibly required:
a) 10 years;
b) At least 5 relevant disputes:
— With value of the claim exceeding 200 000 EUR each,
— 1 of which must involve a public entity,
— 1 of which must involve a dispute in the industrial, engineering or energy sector;
c) At least 10 mediators, each of them meeting the following requirements:
— 5 years of experience as mediator in international commercial disputes,
— Perfect command of English (C2 level in the common European framework for foreign languages or equivalent);
d) Possession of Mediation rules of procedure and template of Mediation Agreement developed by the Mediation Centre;
e) 3 rooms, 1 of which shall be a room for plenary meetings capable to accommodate at least 10 people, office hardware and catering equipment;
f) Adhesion to EU Mediator Code of conduct or equivalent.

Submission of the requests for clarification and information exchanges will be done through the Industry and Associations Portal of Fusion for Energy accessible at the following address: https://industryportal.f4e.europa.eu/IP_PAGES/ADM.aspx It is a responsibility of the tenderers to regularly check the information available on the Portal.
The Invitation to Tender Letter and the Tender Specifications will detail the modalities for submission of the tenders and the contacts between Fusion for Energy and the tenderers.
The tenders can be delivered by registered post, express courier or hand delivery. Details and address are available in the Invitation to Tender Letter.
Late delivery will lead to the exclusion from this procurement procedure.
The present procurement procedure is governed by the rules laid down in the Financial Regulation applicable to the General Budget of the Union (Regulation EU, Euratom No 966/2012 of the 25.10.2012) and its Rules of Application (Commission Delegated Regulation EU No 1268/2012 of 29.10.2012).
Fulfilment of the conditions of this procurement procedure and/or initiation of a tendering procedure impose no obligation on Fusion for Energy to award the Contract. Fusion for Energy is not liable for any compensation to tenderers whose tenders have not been accepted nor is it so liable if it decides not to award the Contract or not to sign a Contract that has been awarded.
