Notice of call for expressions of interest

Application procedure:

The objective of this call for expressions of interest is to set up a list of pre-selected candidates.
Expressions of interest should be submitted in one of the official languages of the European Union by electronic means at the following address: jrc-iet-procurement@ec.europa.eu mentioning the reference of the call JRC/PTT/2015/F.2/0115/AMI.
Inclusion on the list entails no obligation on the part of the contracting authority concerning the conclusion of contracts.
3.
Information and documents to be provided:

Interested parties should provide their full contact details and list the specific fields indicated at point 7 that interest them in their expression of interest.
The supporting evidence to be provided for the evaluation of the selection criteria is indicated at point 11.
Candidates shall provide a declaration on their honour to be found at https://web.jrc.ec.europa.eu/callsfortender/index.cfm?action=app.homepage&type=4 stating that they are not in one of the situations of exclusion listed at point 10. It is to be duly signed and dated by an authorised representative. In case of doubt, they may be requested to provide supporting evidence of non-exclusion.
4.
General description of the procedure:

Interested parties are invited to submit an expression of interest in accordance with the rules set out in this notice.
The contracting authority will draw up a list of pre-selected candidates who meet the criteria set out at point 11. This list comprises sub-lists, corresponding to each of the fields described at point 7.
Where a specific contract relating to the field described at point 7 is to be concluded, the contracting authority will invite all the candidates on the relevant sub-list(s), to submit a tender. The contracting authority will send these candidates the tender specifications relating to the contract in question.
5.
Protection of personal data:

If processing your expression of interest involves the recording and processing of personal data (such as your name, address and CV), such data will be processed pursuant to Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18.12.2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. Unless indicated otherwise, your reply to this notice and any personal data requested are required for the purposes indicated above in point 4 and will be processed solely for those purposes by the contracting authority indicated in point 1, which is also acting as data controller. Your personal data may be registered in the early warning system (EWS) only or both in the EWS and central exclusion database (CED) by the Accounting Officer of the Commission, should you be in one of the situations mentioned in:

Use of the list resulting from this notice:

The list resulting from this notice will be used exclusively for public procurement contracts of the following types:
— service contracts below 130 000 EUR per year per sub-list,
— supply contracts below 130 000 EUR per year per sub-list.
7.
Full description of the fields covered by the call for expressions of interest:

The Joint Research Centre (JRC) runs several laboratory facilities having different scopes and serving different purposes at different locations within the campus of the Institute for Energy and Transport (IET), in Petten (North Holland). These facilities have extensive gas tube/pipe networks (with dimensions in imperial and metric units) including (automated) controls and auxiliary devices (i.e. suction huts, vent and exhaust pipes, etc.) and use various fluids (gases and liquids) at different pressures (normally 10 bar working pressure but in some facilities, up to 1 000 bar working pressure) and flow rates (up to 5 000 normal litres per minute, NL/pm) depending on the facilities at which they are required; some of the gases are harmful (asphyxiate, toxic and/or flammable).
The Commission seeks to establish 3 sub-lists A, B and C of selected candidates for the performance on a project-by-project base of different tasks whether or not ordered jointly or separately under either sub-list, namely:
Sub-list A — Design and engineering in gas installation
The activities to be performed depending on the particular project include all or any of:
a. preliminary review of existing gas installation system of the JRC-IET and formulation of a revised risk assessment report based on applicable rules and regulations, standard and industry practice, to be used as the reference for all subsequent activities;
b. drawings (on paper and in electronic format) as detailed as required by the nature and scope of the project;
c. an itemised bill of materials of all necessary items with name/type/specification, unit, quantity, supplier name, supplier reference, catalogue page and estimated prices for the performance of tasks given in the sub-list B below; and
d. an estimate for the total duration to implement the project.
Sub-list B — Projects for new installations, repairs including upgrade of existing installations
The activities to be performed depending on the particular project include all or any of:
a. installation including assembly using the items either supplied as a result of the performance of a project under a field in sub-list C or otherwise provided by the Commission and manufacture of parts and components to be joined with or used by the installation or equipment, as the case may be;
b. commissioning (functionality and safety testing) according to applicable rules, codes and standards attested by certificate(s) of the performed work;
c. necessary programming including software supply and update(s)/upgrade(s) and functional testing for the installation and equipment(s) to be ready-to-use safely and as intended;
d. documentation (in English) including as-built drawings with used materials and manual; and
e. operational training on the as-built installation to technical staff of the Commission as required.
Sub-list C — Supply of materials, components, devices and instrumentation in the framework of gas installations
The supply of CE-labelled item(s), covered by 2-years' warranty, as will be specified in the technical requirements in future requests for quotation related to gas installation as below:
a. mechanical hardware (i.e. tubes and pipes whether plastic, metal, flexible or rigid, fittings, valves, gaskets/sealings, fixing and routing materials, technical cabinets, fire-resistant and ex-proof cupboards, manifold boxes, wires, cables, etc.);
b. electrical hardware and electronic components including operation software; and/or
c. acquisition, control and instrumentation device(s) (i.e. printed circuit boards, displays, pressure, flow, temperature, humidity, fluid composition indicators/sensors, etc.).

It is to be noted that this list of categories or products and suppliers is non-exhaustive and equivalence will be accepted as long as the supplier can provide the proof of the equivalence.

9.
Expiry date of the list resulting from this call for expressions of interest:

The list resulting from this notice is valid for 3 years from dispatch of this notice. Interested parties may submit an application at any time prior to the last 3 months of validity of the list.
10.
Exclusion criteria:

Candidates shall be excluded from participation if:
(a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
(b) they or persons having powers of representation, decision-making or control over them have been convicted of an offence concerning their professional conduct by a judgment of a competent authority of a Member State which has the force of ‘res judicata’;
(c) they have been guilty of grave professional misconduct proven by any means which the contracting authority can justify including by decisions of the European Investment Bank and international organisations;
(d) they are not in compliance with their obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;
(e) they or persons having powers of representation, decision-making or control over them have been the subject of a judgment which has the force of ‘res judicata’ for fraud, corruption, involvement in a criminal organisation, money laundering or any other illegal activity, where such an illegal activity is detrimental to the Union's financial interests;
(f) they are subject to an administrative penalty for being guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in a procurement procedure or failing to supply information, or being declared to be in serious breach of their obligation under a contract covered by the budget;
(g) they have a conflict of interest in connection with the contract; a conflict of interest could arise in particular as a result of economic interests, political or national affinities, family or emotional ties or any other relevant connection or shared interest.
11.
Selection criteria:

i. Criteria relating to financial and economic capacity (all sub-lists)
a) a statement as to the candidate organisation's annual overall turnover, over the past 3 financial years for which accounts have been closed.
Minimum required: turnover of 200 000 EUR during the past financial year for which the accounts have been closed or at least 200 000 EUR as an average over the past 3 financial years for which accounts have been closed.
ii. Criteria relating to technical and professional capacity — sub-list A
b) A1 — expertise in the engineering and manufacturing of similar facilities by an indication of contracts for supply and/or projects performed in the past 3 years indicating the title and subject of the contract, the recipients, the start and end dates and the contractual amount (the latter may be indicated on a separate page to the main list for confidentiality reasons).
Minimum required: at least 3 contracts valued at not less than 75 000 EUR. A letter or certificate of good completion for at least 1 contract should be provided;
b) A2 — the personnel performing works on site and/or those who communicate with technical staff of the Commission should do so in English.
Minimum required: at least B.1 level attested by a certificate (or equivalent).
iii. Criteria relating to technical and professional capacity — sub-list B
c) B1 — training and qualification requirements of persons carrying out the services: technical personnel and project leader shall be properly trained and qualified. They must have the required professional education with a minimum level 5 (technical personnel) and level 6 (project leader) of the European Qualifications Framework (EQF) in mechanical/industrial engineering, civil/structural engineering, fluid mechanics, process engineering, electrical/electronics engineering and automation attested by certificate(s).
Minimum required: any sector of NACE codes (certificates to be provided with the expression of interest): C.25.2, C.33.20, D.35.22, D.35.30, F.42.21 and M.71.1;
c) B2 — the personnel performing works on site and/or those who communicate with technical staff of the Commission should do so in English.
Minimum required: at least A.2 level attested by a certificate (or equivalent).
iv. Criteria relating to technical and professional capacity — sub-list C
d) C1 — confirmation (by the signature of a declaration of honour) that the items in the public catalogues can be supplied to the Commission premises.
Minimum required: at least 5 vendors as listed under point 7;
d) C2 — the personnel communicating with technical staff of the Commission should do so in English.
Minimum required: at least A.2 level attested by a certificate (or equivalent).
12.
Ex-post transparency:

Details on the contractors who have concluded a contract of more than 15 000 EUR awarded following the procedure set out at point 4 shall be published on the website of the contracting authority no later than 30 June of the year following contract award.
These details include name, locality (address for legal persons and region of origin for natural persons), amount, and subject of the contract. For natural persons, the information shall be removed 2 years after the year of contract award.
