Framework Service Contracts shall be awarded to the maximum of 2 highest-ranked tenderers per each Lot and enter into force on the date of signature of the last contracting party, They shall be valid for a period of 24 months and may be renewed automatically 2 times for the duration of 12 months each, covering a total period of 48 months.
The maximum Contract value for Lot 1 cannot exceed 1 800 000 EUR (one million eight hundred thousand euros) for the total maximum duration of 48 months, without this amount being binding for Fusion for Energy.
The maximum Contract value for Lot 2 cannot exceed 400 000 EUR (four hundred thousand euros) for the total maximum duration of 48 months, without this amount being binding for Fusion for Energy.

Information and formalities necessary for evaluating if the requirements are met: Exclusion criteria: Tenderers shall provide a Declaration on their Honour on Exclusion and Selection criteria, duly signed and dated, stating that they are not in 1 of the situations listed in Annex IV of the Tender Specifications, based on the template provided therein. The tenderer to whom the Contract is to be awarded shall provide the documents mentioned in the same Annex before signature of the Contract while proving that they are not in 1 of those situations.

The Letter of invitation to tender and the Tender Specifications will detail the modalities for submission of the tenders and the contacts between Fusion for Energy and the tenderers.
The tenders can be delivered by registered post, express courier or hand delivery. Details and address are available in the Letter of invitation to tender.
Late receipt will lead to the exclusion from this procurement procedure.
The present procurement procedure is governed by the rules laid down in the:
— Financial Regulation of Fusion for Energy adopted by the Decision of the Governing Board of 2.12.2015;
— Financial Regulation (EU, EURATOM) N° 966/2012 of 25.10.2012 as last amended by Regulation (EU, EURATOM) N° 2015/1929 of 28.10.2015;
— Commission delegated Regulation (EU) N° 1268/2012 of 29.10.2012 as last amended by Commission Delegated Regulation (EU) N° 2015/2462 of 30.10.2015.
Fulfilment of the conditions of this procurement procedure and/or initiation of a tendering procedure impose no obligation on Fusion for Energy to award the Contract. Fusion for Energy is not liable for any compensation to tenderers whose tenders have not been accepted nor is it so liable if it decides not to award the Contract or not to sign a Contract that has been awarded.
