— Rig supplier = Contractor.

The scope of supply for the drilling tender includes the total of the drilling operations (coring, drilling and reaming), including all required services, personnel and materials for the well construction (for example, bits, casing, cementing, string, etc.).

The total project consists of several sets of 1 (one) firm well and 2 (two) optional wells each; all vertical (<3o inclination).

Contractor may submit a maximum of two offers whereby each offer stands independently for itself which means that each offer refers to a separate rig and team.

Operator will assign the individual wells to the different sets in due time at his own discretion. All sets are to be drilled with different rigs.

All wells are to be drilled from different drilling sites.

CONTRACTOR must adhere to all specifications as detailed in the license requests.

Basic procedural principles:

— the Operator will sign the contracts only with partners, which commit to comply with the occupational health and safety regulations and working conditions valid for employees in Switzerland and in the specific location for the performance of the work, as well as with the existing regulations. Furthermore, for the services performed in Switzerland under the Project or the Work, the Contractor commits to maintain, wage equality for men and women,

— additional information: Nagra reserves the right to freely award further similar tasks related to this basic contract (submission decree of the canton of Aargau § 8, para. 3, lit. i).

Procedures for appeal:

— Right to appeal:

1) This order may be filed in German within a non-extendable period of 10 days from the date of publication at the Administrative Court of the Canton of Aargau, Obere Vorstadt 40, 5001 Aarau. The standstill of the deadlines according to civil procedure law does not apply;

2) The complaint must be submitted in written form and must include an application and a statement of reasons. That means it has to be:

a) stated how the administrative court should decide, and;

b) explained why this other decision is required;

3) A complaint that does not comply with the requirements of paragraphs 1 and 2 will not be processed;

4) The contested call for tender must be specified, any evidence must be identified and enclosed, as far as possible. The entry is to be signed;

5) The complaint procedure involves a cost risk, i.e. the unsuccessful party usually has to pay the costs of the proceedings and, if applicable, the adversarial costs of the claimant.
