Short description:
Mit der Automatisierung von Wetterwarten müssen Aufgaben, welche vormals durch eigenes Personal durchgeführt wurden, vergeben werden. Dies betrifft im weiteren Sinne die Pflege und die Betreuung der Station. Im Einzelnen muss sichergestellt werden, dass einerseits die Liegenschaft regelmäßig betreut wird, andererseits die meteorologischen Sensoren und die Messsysteme zur Ermittlung der in der Atmosphäre und im Boden vorhandenen Radioaktivität gepflegt werden.

Im Zuge der sukzessiven Automatisierung des Messnetzes des Deutschen Wetterdienstes werden vier weitere Wetterstationen in 2018 automatisiert und eine Wetterstation zum 1.2.2019.

Die Betreuung und Pflege dieser Wetterstationen mit Radioaktivitätsmessungen ist Gegenstand dieser Ausschreibung.

Unternehmen haben gemäß § 97 Absatz 6 GWB einen Anspruch darauf, dass die Bestimmungen über das Vergabeverfahren durch den öffentlichen Auftraggeber eingehalten werden.

Sieht sich ein am Auftrag interessiertes Unternehmen durch Nichtbeachtung von Vergabevorschriften in seinen Rechten verletzt, ist der Verstoß innerhalb einer Frist von 10 Kalendertagen beim öffentlichen Auftraggeber zu rügen (§ 160 Absatz 3 Nr. 1 GWB).

Verstöße, die aufgrund der Bekanntmachung oder der Vergabeunterlagen erkennbar sind, müssen spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem öffentlichen Auftraggeber gerügt werden (§ 160 Absatz 3 Nr. 2-3 GWB).

Teilt der öffentliche Auftraggeber dem Unternehmen mit, seiner Rüge nicht abhelfen zu wollen, so besteht die Möglichkeit, innerhalb von 15 Tagen nach Eingang der Mitteilung einen Antrag auf Nachprüfung bei der zuständigen Stelle für Nachprüfungsverfahren zu stellen (§ 160 Absatz 3 Nr. 4 GWB).

Bieter, deren Angebote für den Zuschlag nicht berücksichtigt werden sollen, werden gemäß 134 GWB hierüber informiert. Dies gilt auch für Bewerber, denen keine Information über die Ablehnung ihrer Bewerbung zur Verfügung gestellt wurde, bevor die Mitteilung über die Zuschlagsentscheidung an die betroffenen Bieter ergangen ist.

Ein Vertrag darf erst 15 Kalendertage nach Absendung dieser Information durch den öffentlichen Auftraggeber geschlossen werden; bei Übermittlung der Information per Fax oder auf elektronischem Wege beträgt diese Frist 10 Kalendertage. Sie beginnt am Tag nach der Absendung der Information durch den öffentlichen Auftraggeber; auf den Tag des Zugangs beim betroffenen Bieter und Bewerber kommt es nicht an.

Ein Antrag auf Nachprüfung ist schriftlich an die zuständige Stelle für Nachprüfungsverfahren zu richten.
