Short description:
The objective of this project is to assist the European Commission in monitoring and assessing Member States' transposition of the provisions of Council Directive 2013/59/Euratom (hereinafter referred to as “the Directive”) into national law.

The Contractor shall carry out a thorough analysis of European Union (EU) Member States' transposition of the Directive into national legal frameworks. The data analysed at legal and technical level and the conclusions drawn by the Contractor, shall provide the Commission with the necessary tools to decide on the completeness and adequacy / correctness of transposition in each case.

II.2.4)
Description of the procurement:
The Euratom Treaty empowers the European Atomic Energy Community to establish uniform basic safety standards to protect the health of workers and the general public against dangers arising from ionising radiations. To this end, a comprehensive set of European radiation protection legislation was developed ensuring the highest level of radiation protection for members of the public, workers and patients.

In 2013, this Framework was modernised and consolidated by adopting Council Directive 2013/59/Euratom which introduced a number of new and strengthened requirements, the transposition and implementation of which is currently being undertaken by EU Member States.

The transposition deadline of the Directive was 6.2.2018. Article 106 of the Directive requires Member States to bring into force the laws, regulations and administrative provisions necessary to comply with the Directive within the prescribed deadline and communicate them to the Commission.

The Commission needs to verify the completeness and conformity of national transposition measures with the specific provisions of the Directive for all 28 Member States following the notification of such measures to the Commission. Consequently, the Commission seeks assistance from a contractor with specialised legal and technical knowledge related to the field of radiation protection.

The contract shall comprise the following tasks:

Task 1:

Understanding of the provisions of the Directive: The Contractor shall develop a clear understanding of all provisions of the Directive, their legal and technical specificities, to ensure consistency of the conformity assessment across Member States;

Task 2:

The “prima facie” check: The Contractor shall verify the completeness of transposition of the provisions of the Directive into national legislation, indicating whether the transposition is partial or complete;

Task 3:

The conformity assessment: The Contractor shall perform an in-depth legal and technical analysis of the conformity of national transposition measures with the provisions of the Directive;

Task 4:

Translation of the national legislative measures transposing the Directive: The Contractor shall provide translations into English of the relevant parts of national legal provisions that transpose the Directive.
