Terms of business: General terms and conditions applicable to the contracts for procurement of goods and services awarded by the domain of the Swiss Federal Institutes of Technology as of September 2016 (with amendments of September 2016). GTC's of suppliers are expressly excluded.

Negotiations: Remain reserved.

Basic procedural principles: The client only awards public commissions for services in Switzerland to tenderers who comply with job security regulations and the conditions of work for employees, and provide equal payment for men and women. Integrity clause the bidder and the instructing party undertake to take all necessary measures to avoid corruption, in particular that no payments, gifts or other advantage will be offered or accepted. Should this integrity clause be disregarded, the contractor must pay a contract penalty. This will amount to 10 % of the contract value, a minimum of 3 000 CHF - per contravention. The bidder should take note that a contravention of the integrity clause generally results in the annulment of the tender and the premature termination of the contract for important reasons by the instructing Party.

Additional information: The supplier must confirm in writing the acceptance of the terms of business (4.2) and the basic procedural principles (4.4).

Procedures for appeal: Pursuant to Art. 30 of the federal act on public procurement, an appeal against this publication may be filed within 20 days since notification in writing in an official language of Switzerland to the Federal Administrative Court, Postfach, 9023 St.Gallen. The appeal petition must be submitted in duplicate and must contain the application, the grounds of appeal with details of the evidence and the signature of the appellant or his agent; a copy of the present publication and documents cited as evidence must be attached, provided they are in the appellant’s possession.

In case of discrepancies between the paper copy and the electronic copy, the following sequence applies:
