1. Кандидатите и участниците следва да отговарят на поставените от възложителя изисквания в документацията за обществената поръчка относно личното състояние, критериите за подбор, техническото и ценово предложение.

2. Възложителят отстранява кандидат или участник, в зависимост от етапа на процедурата, за когото са налице основанията по чл. 54, ал. 1 и обстоятелствата по чл. 55, ал. 1, т. 4 и 5 от ЗОП, възникнали преди или по време на процедурата. Отстраняването се прилага и когато участникът е обединение от физически и/или юридически лица и за член на обединението е налице някое от горепосочените основания и обстоятелства. Ако за участник са налице тези основания и обстоятелства, той има право да представи доказателства за предприети мерки за надеждност при условията на чл. 56, ал. 1 от ЗОП. Възложителят преценява мерките и в случай че те са достатъчни, за да се гарантира неговата надеждност, възложителят не го отстранява от процедурата.

Специфични национални основания за изключване:

— чл. 3, т. 8 от ЗИФОДРЮПДРСТЛТДС — на дружествата, регистрирани в юрисдикции с преференциален данъчен режим, и на контролираните от тях лица се забранява пряко и/или косвено участие в процедура по обществени поръчки по Закона за обществените поръчки и нормативните актове по прилагането му, независимо от характера и стойността на обществената поръчка, включително и чрез гражданско дружество/консорциум, в което участва дружество, регистрирано в юрисдикция с преференциален данъчен режим. Чл. 5, ал.1 от същия: когато въз основа на неверни данни е приложено изключение по чл. 4, кандидатът се отстранява от участие в процедурата по обществена поръчка,

— чл. 101, ал. 11 от ЗОП: свързани лица не могат да бъдат самостоятелни участници в една и съща процедура и на основание чл. 107, т. 4 от ЗОП възложителят отстранява от процедурата участници, които са свързани лица. Ако участник, класиран на 1 или 2 място не удължи валидността на офертата си при поискване, същото ще се счита за отказ от сключване на договор.

Към т. IV.2.6. относно валидността на офертата: Участниците ще бъдат отстранявани, ако при поискано удължаване на валидността на офертите им от възложителя, същото на бъде направено.

Получените заявления ще се отворят на 23.8.2018 г. от 10:00 часа на публично заседание в у-ние „Търговско" на „АЕЦ Козлодуй" ЕАД, на което могат да присъстват кандидатите или техни упълномощени представители, както и средствата за масово осведомяване.
