Multiannual contract for a term of three (3) years (2019-2021) of which 1 year optional for the supplying of a maximum quantity of 240 metric tons of boric acid nuclear grade per year.

Section III: Legal, economic, financial and technical information
III.1) Conditions for participation III.1.1) Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers List and brief description of conditions: — Candidates must deliver a dated and signed affidavit attesting that they are not prohibited from tendering under any of the ban provisions of Articles 45 and 48 of Decree No.2015-899 dated 23.7.2015 relative to public procurement contracts. Said affidavit must be delivered by individual candidates, by each member of a candidate consortium, and as appropriate by any proposed subcontractors,
— Candidates must deliver an official extract of the relevant trade registry, dated no earlier than 3 months before, such as a “K bis” extract or an equivalent document delivered by a competent judicial or administrative authority in the country of origin or establishment of the candidate. Said document must be delivered by individual candidates and by each member of a candidate consortium,
— If the candidate’s company is in receivership (redressement judiciaire), a copy of the court order(s) must be delivered attesting that the company is authorized to continue its business activities throughout the term of the contract performance. Said document must be delivered by individual candidates and by any candidate consortium member affected by such proceedings,
— Candidates must produce certificates delivered by competent administrations and authorities attesting their compliance with tax and social security obligations. Said certificates must be provided by individual candidates and by each member of a candidate consortium.
III.1.2) Economic and financial standing List and brief description of selection criteria: Candidates must provide evidence of an annual revenue of at least 5 000 000 EUR (5 million euro) over the last 3 fiscal years.
III.1.3) Technical and professional ability List and brief description of selection criteria: Candidates must provide:
— Evidence attesting to their ability to supply Boric Acid with a Boron10 isotope (10B) content higher than 19.9 % (atomic %),
— The country of origin of the mine extracting the raw boron used by the candidate to produce the end product (nuclear grade boric acid for operation of EDF nuclear reactors),
— The country where the nuclear grade boric acid will be produced.
Any candidacy application must mandatorily attach all of the documents attesting that the candidate complies with all the above-mentioned participation requirements.
The contract outsourcer reserves the possibility of sending an additional dossier to review the candidate’s suitability.
For information purposes, the tendering dossier will mention the supplier’s obligation to comply with the REACH directive and meet the accreditation requirements of EDF (product specification and quality assurance system, among other).

III.1.8) Legal form to be taken by the group of economic operators to whom the contract is to be awarded: EDF accepts consortia (groupements) of jointly and/or severally liable companies. In case of a consortium, one of the consortium members shall be appointed as lead Agent. For contract execution purposes, the Agent shall be jointly and severally liable for each of the consortium members as related to their respective contractual obligations toward EDF.
Without prejudice to Article 50.I of the Decree dated 23.7.2015, the membership of a consortium may not be modified between the delivery date of the candidacy application and the date of signature of the contract, except in the event of a company restructuring or if the consortium provides evidence that one of its members is incapable of accomplishing its task for reasons out of its control.
Furthermore, a tenderer who submits a proposal on behalf of a consortium of companies, may not submit another proposal on its own individual behalf or on behalf of another consortium.

EDF reserves the possibility of awarding the contract based on the initial proposals without any negotiation.
