De levering bestaat uit ca. 770 stuks stalen platen (bestaande uit 221 unieke stalen plaatdelen + overige plaatdelen), inclusief montagemateriaal, welke zeer nauwkeurig gedraaid, nabewerkt en rondom behandeld dienen te zijn. Er wordt van Opdrachtnemer dan ook een hoge mate van precisie en kwaliteit verwacht.

De levering van de platen hangt nauw samen met de planning en voortgang van de opbouw van de Waste Transfer Unit (WTU) en zal daarop afgestemd moeten worden. De levering van de platen zal gefaseerd (en op afroep) plaats moeten vinden, aangezien er onvoldoende (tijdelijke) opslagcapaciteit op locatie Petten beschikbaar is om alle platen tijdelijk op te kunnen slaan.

Indien een Gegadigde respectievelijk Inschrijver zich niet kan vinden in de mededeling van de selectiebeslissing respectievelijk gunningsbeslissing dient hij – op straffe van niet-ontvankelijkheid en verval van recht – binnen een termijn van tien (voor de selectiebeslissing) respectievelijk 20 kalenderdagen (voor de gunningsbeslissing) na dagtekening van de verzending van de mededeling van de selectiebeslissing respectievelijk gunningsbeslissing, door betekening van een dagvaarding, een kort geding aanhangig te hebben gemaakt tegen voorgenoemde beslissing van de Aanbestedende dienst, bij de voorzieningenrechter van de rechtbank Noord-Holland.

Indien binnen deze termijn van tien (10) respectievelijk twintig (20) kalenderdagen een kort geding aanhangig is gemaakt, zal niet worden overgegaan tot definitieve selectie respectievelijk gunning van de opdracht voordat in kort geding vonnis is gewezen, tenzij een zwaarwegend belang onverwijlde selectie gebiedt.

Indien niet binnen tien (10) respectievelijk twintig (20) kalenderdagen na verzending van de mededeling van de selectiebeslissing respectievelijk gunningsbeslissing een kort geding aanhangig is gemaakt, kunnen de belanghebbenden geen bezwaren meer maken naar aanleiding van de beslissing en hebben zij hun rechten ter zake verwerkt. De Aanbestedende dienst is in dat geval dan ook vrij om gevolg te geven aan de geuite beslissing.
