The subject of the Contract is the provision of painting and coating works for the Tokamak complex buildings i.e. Tokamak, tritium and diagnostics, as set out in the Technical specification (Annex B) and in conformity with the terms of the Specific tender conditions, the General tender conditions and the Management specifications. The Contract consists in baseline scope and if released, 5 options for additional scope as per section II.2.11.

The scope includes painting and coating works and related services for the Tokamak complex buildings i.e. Tokamak, trititum and diagnostics of approximately one hundred and eighty thousand square meters (180 000 m2) for the baseline and all options.

Option 3:

— TB19-O03-02: Crane Hall in the Tokamak building (62.11).

— TB19-O03.04: South wall between the Tokamak (62.11) and Assembly hall building (62.13):

— TB19-O03-06: Sump SU1 Tritium building (62.14) B2 Level.

Option 4:

— TB19-O04-02: Bioshield walls in the Tokamak building (62.11).

(i) This procedure is governed by

(a) Regulation (EU, EURATOM) 966/2012 as amended by Regulation (EU, Euratom) 547/2014 (Financial Regulation) and Regulation (EU, Euratom) 2015/1929;

(b) Commission Delegated Regulation (EU) 1268/2012 as amended by Commission Delegated Regulation (EU) 2015/2462 (Rules of Application) and

(c) the derogations adopted by Fusion for Energy's Governing Board on 2.12.2015.

(ii) In case of new contract(s) consisting of repetition of similar works or services entrusted to the economic operator to which fusion for energy awarded the original contract, fusion for energy may use the negotiated procedure in accordance with Article 134 RAP

(iii) Fusion for energy will invite for a site visit the candidates that have been invited to submit a tender prior to the aforementioned tender submission.

(iv) Provision of the CCTR and Note technique documents under this procedure is subject to the signature of a confidentiality and non-disclosure agreement by the receiving party.
